Can I sue my son's school?

This is my son first year attending this school(pricate christian school?.Ok, so these kids go to school sit around in cl doing nothing and most of the time are there before the teachers.All of the teachers have now quit because of the financial situation at the school, the pastor is the person who owns the school and he still is forcing the parents to pay tuition when there teachers are now bible-pastor,math-pastor,history-bball coach,english-his mother in law(yes i said it,and she's about 70). They do not take science,foreign language,or gym. Yes, I have tried to transfer him but no schools in the area will accept him until next year.Is this a case I can take to court? He has no other schools to go to so that he can finish the year, and the pastor will not give him fourth quarter grades unless tuition is paid.He seems like a con artist to me.There is now only 7 kids left in the school.
